Terms and Conditions

Definitions:

CONTEST: The Prize Draw Competition operated by the Promoter to which these Terms and Conditions Apply, wherein the Entrants submit entries via the website www.property-lotto.com or by post to win the Prize.

PRIZE: £200,000 to spend on a property of their choice within the United Kingdom (such sum to be inclusive of any survey fees, legal fees, Stamp Duty Land Tax (or similar), search fees, Land Registry fees and other costs and expenses reasonably incurred).

This can also be used as a part deposit or to pay off an existing mortgage, make home improvements or buy a second home or investment property.

Prize can be used for any purchase of a UK property up to a total value of £200,000. At least 75%, including fees MUST be spent on property.

In the event that the requisite ticket sales are not achieved the Promoter may award a cash prize of 66.7% of gross ticket sales receipts in the alternative.

ENTRANT:  Any person (not including a limited company, partnership or limited liability partnership) who enters the Competition through the Website or by post to win the Prize.

WINNER: The Entrant chosen at random on or after the Prize Draw Date in accordance with these Terms and Conditions.

OPENING DATE: 1 August 2023 at 9:00am

PRIZE DRAW DATE: As soon as reasonably practicable (in the absolute discretion of the Promoter) after each 150,000 tickets per individual prize draw are sold or sooner if so determined by the Promoter (in its absolute discretion).

POSTAL ENTRY: Postal entries must be sent on a postcard or sealed envelope to the address shown below, clearly showing the entrants name, address, postcode, mobile or landline telephone number and email address. Postal Entry entrants are responsible for all costs associated with creating, conducting and posting their own postal entry(ies). General

By entering the competition via the Website or by purchasing tickets at a store of the Charity, Entrants are deemed to have read and accepted these Terms and Conditions and agree to be bound by them.

Upon entering the Competition, all Entrants must submit all contact details requested by the Promoter (which must include a valid e-mail address) which will be used for the following purposes:

(a) to notify the Winner that they have won the prize;

(b) to post the Winner’s name and town of residence on the Website; and

(c) to comply with the Privacy Policy.

All entrants are solely and completely responsible for providing the Promoter with accurate and current contact details.

The Promoter will be in no way liable for any failure or inability to make contact with any Entrant due to any errors, omissions or inaccuracies in the contact details provided by the Entrants or otherwise.

Privacy policy – The Entrants and the Promoter recognise that the Promoter may use contact details and other data including personal data as defined by the Data Protection Act 1998 (including any relevant data protection legislation that supplements or replaces it), as supplied by the Entrants to the Promoter to administer the Website and conduct the Competition according to these Terms and Conditions. The Entrants and the Promoter also recognise that the Promoter may (either by choice or at the request of a third party) also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.

The Prize Draw Competition is operated by the Promoter on behalf of the Charity.

The Prize Draw Competition is open for entry to all persons aged 18 or over, excluding the Promoter, their family, agents, employees, professional advisers or anyone else connected with the development or operation of the Website or conductor administration of the Prize Draw Competition in any way, shape or form.

Entries made by the Entrants to the Prize Draw Competition will only be valid if made via purchase of tickets at a store of the Charity, via the Website or by post to the address given above and on the Enter Here Page.

Will tickets only be available at Sports Traider stores or via the website?

By entering into the Prize Draw Competition, all Entrants acknowledge that their payment of £10.00 (GBP) per 5 entries or postal entry to enter the Prize Draw Competition does not guarantee in any way that they will win the prize.

The Promoter does not in any way guarantee the value of the Property as this will be chosen by the Winner.  Further the Promoter shall not be responsible for verifying the structural condition, value or any other matters which may have an effect on the Property nominated by the Winner.

Only completed Entries will be entered into the Prize Draw Competition.

As a condition of entering the Prize Draw Competition, Entrants must ensure that, by doing so, they do not contravene any laws of their country of residence. The Promoter will not be liable in any way if an Entrant enters the Prize Draw Competition unlawfully.

The Entrants and the Promoters recognise that the Prize Draw Competition, its administration and all associated activities are governed by English and Welsh Law and the Promoter and Entrants recognise that the Courts of England and Wales shall have exclusive jurisdiction in the event of any dispute arising out of the Prize Draw Competition or its administration.

By entering the Prize Draw Competition, Entrants warrant that all information which they submit is accurate, true, current and complete. The Promoter reserves the right to disqualify any entrant (entirely at their own discretion) if there are reasonable grounds to believe the Entrant has acted in breach of any of these Terms and Conditions.

There is no limit to the number of entries that any one person can make via this website or by post.

All Entries both material and financial will become the real property of the Promoter on receipt and will not be returned.

The Promoter reserves the right to amend these terms and conditions at any time and for any reason.

Your contact details, including email address, may be stored electronically, and covered under the Data Protection Act, and used to contact you in future with regards to further competitions or promotions. Please email us if you do not want us to keep your details on file.

Your details will not be sold or shared to any third party company for the purposes of marketing.

All monies will be held in a separate account until the conclusion of the Prize Draw Competition.

English or Welsh are the only languages in which an Entrant may submit their entry.

The Prize

The purpose of the Prize Draw Competition is to win The Prize.

Further details in relation to the Promoter’s title to The Prize can be found on the Website.

The Prize will be used by the Promoter to purchase a property (or otherwise be spent on a property or mortgage or similar as approved by the Promoter) nominated by the Winner free from all mortgages, charges and other encumbrances up to a maximum of £200,000 but for the avoidance of doubt any legal fees, surveyors fees, Stamp Duty Land Tax (or similar), search fees, Land Registry fees and other fees and expenses reasonably incurred (if any) shall be deducted from the sum of £200,000.

The Promoter shall use reasonable endeavours to ensure that the Property is registered at HM Land Registry in the Winner’s name. Payments will only be accepted in pounds sterling.

The Promoter shall not be responsible for the property.  In the event the property is damaged, destroyed, deemed uninhabitable or otherwise not available as expected on transfer date a right of substitution of the prize by the Promoter to another prize of equal value is at its entire discretion.  The Promoter shall be under no obligation whatsoever to do so.

The Contest

The process to determine the Winner will be via a live draw.

All entrants are welcome to confirm with the Promoter that all tickets are entered into the draw.

The winner will be notified by email within 48 hours.

If entering by ticket, the price of entering the Prize Draw Competition is £10.00 (GBP) per 5 entries and is payable at the stores of the Charity or by using the “Buy Now” button on the “Enter Here” page of the Website.

To conclude an entry into the Prize Draw Competition, an Entrant will be asked to provide their contact details (including postal and e-mail addresses and, preferably, a telephone number) and payment. Each Entrant will receive a confirmation e-ticket via email prior to the draw. Each Entrant must provide a valid email address.

When the Maximum Number of Entries per prize draw is reached [150,000] that specific Prize Draw will close and the Draw will take place.

All Entries to the Prize Draw Competition are final and no refunds shall be made at any time or for any reason.

The winner of the Prize will be the Entrant whose details are randomly drawn before an audience of invited guests and members of the Press. This will also be filmed and placed on the Promoter’s website and Facebook Page.

The Promoter’s decision is final and no correspondence will be entered into about the result of the Prize Draw Competition following the determination of the Winner as described above.

The Winner will be required to forward a copy of their passport or driving licence or such other form of identification and proof of address to the Promoter’s Legal Department to prove their identity to the satisfaction of the Promoter and their conveyancers and that their Entry was made using a valid debit/credit card belonging to the Entrant or used with the express authorisation of the card holder.

Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 [as amended] for any goods and services ordered online to be supplied within 30 days will not apply to this Prize Draw Competition.

If the Winner cannot be contacted by the Promoter within 21 days of being notified of their status as the Winner by e-mail, telephone and mail to the contact details submitted in their entry, the Promoter shall be entitled to award the Prize to the Entrant selected by drawing another winning entry at random in the same method as described above (“The Alternate Winner“). The Alternate Winner shall have 7 days from notification of their status by the Promoter to communicate their acceptance of the Prize.

The Promoter’s conveyancers must act in the acquisition of the Property and/or release of funds to ensure that the Prize is used in accordance with these Terms and Conditions.  The Winner will co-operate fully with the conveyancers nominated by the Promoter and will sign all documentation reasonably required (to include Contract for Purchase, Transfer Deed for the avoidance of doubt) in a timely and diligent manner.

This prize is non-transferable and can only be paid to the Winner as named on the unique e-ticket or free entry postcard, unless deceased in which case it will be paid to their estate.

You may be liable to tax on sale of the land/properties. Please take your own independent advice from an accountant or from HM Revenue & Customs for further clarification

Other Issues

Postal entries must be sent on a postcard or sealed envelope to the address shown at the top of this page under the heading Postal Entry and on the Enter Here page clearly stating the entrants name, address, postcode, phone number and email.

Entry tickets can only be purchased at one of the Charity’s stores or via the website. Property Lotto does not handle cash.

The Prize Draw Competition Winner agrees to allow the Promoter to display his or her name on the Website, on social media, in the press, at the Charity’s stores and otherwise in accordance with the Privacy Policy, unless the Promoter has been notified expressly to the contrary. The name, age and town of residence of the Winner will be posted on the Website for the purposes of announcing the Winner of the Prize Draw Competition within 24 hours of the Winner being determined.

Entrants authorise the Promoter to enter their personal details into their database and to use the information in accordance with the provisions of the Data Protection Act 1998 and subject to the terms of the Privacy Policy and in full understanding and agreement and in compliance with General Data Protection Regulation [GDPR].

The Promoter reserves the right to cancel the Prize Draw Competition at any time either before or after tickets have been sold. If the Prize Draw Competition is cancelled, the Promoter will return the Entry Fees to each Entrant (either by online payment refund, bank card refund or by cheque and in one combined payment where several entries have been made by an entrant). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person;

In the event that less than 150,000 tickets are sold within 90 days, or for any other reason in the absolute discretion of the Promoter, the Promoter may award 66.7% of gross ticket sales receipts to the Winner as the Prize.

The Promoter makes no representation or warranty as to the Valuation of any property, its structural or cosmetic condition or its ability to be sold. Entrants should make and rely on their own enquiries and legal advice about the property.

Save for death or personal injury the Promoter will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoter, nor will their servants or their agents in developing, planning and Administrating the Prize Draw Competition, distributing the Prize to the Winner or following the distribution of the Prize. The Promoter accepts no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this website.

The Promoter will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website.

The Promoter does not accept responsibility for entries which they do not receive due to failures in computer systems, other malfunctions, high Internet traffic, hardware failure, software failure, server faults, undelivered post or any other reason.

These Prize Draw Competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoter.

An entry shall be declared void (without any refund being given) if the entrant engages in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the website; or (e) amending, or unauthorised use of, any of the code that constitutes the Website.

Each entrant should retain a copy of these Terms and Conditions for their future reference.
